Ex-Cop Sentenced to 15 Years in Prison for Killing 24-Year-Old in Majengo

A former police officer who was attached to Shauri Moyo Police Station has been sentenced to 15 years in prison for the murder of 24-year-old Ahmed Majid in the Majengo area in Nairobi, in 2020. 

According to the victim impact assessment report submitted to the court, the accused was not remorseful for his actions, outweighing the mitigations raised by his defence team.

In consideration of the report, the court sentenced the accused to serve as an example to other people planning to commit similar crimes. 

“The court notes as per the probation report which captures the views of the victims that the accused person was not remorseful, they were mentally affected and a life was lost,” the court noted.

Justice Daniel Ogembo, in his ruling, stated that the accused who claimed to have been affected mentally by the death of the victim, failed to express sadness or guilt for the crime committed. 

“He deserves a deterrent custodial sentence that will ensure justice to the family of the deceased and to the accused an opportunity to reform,” the judge stated. 

In a ruling delivered on January 14 at Milimani High Court, Justice Daniel Ogembo approved murder charges against the accused, noting that the prosecution had proved the case beyond reasonable doubt.

The Independent Policing Oversight Authority (IPOA) which led the investigation, recommended that the suspect be charged with murder, as he had shot the victim at short range. 

Prior to the ruling, the accused had requested a non-custodial sentence, arguing that he was the sole provider to his family, who would otherwise struggle if he was out of the picture.  

The incident happened in the Majengo area in Nairobi on January 16, 2020, when a confrontation ensued after the victim questioned why the police had arrested his neighbour over alleged possession of drugs. 

The ex-police then shot Majid, who was pronounced dead upon arrival at the hospital, succumbing to bullet injuries.
